Federal Communications Commission Rules

For frequency hopping systems, at least 75 hopping frequencies in a pseudorandom hopping pattern, separated by at least 25 kHz, shall be used, and the average time of occupancy on any frequency shall not be greater than four-tenths of one second within a 30 second period.  The maximum bandwidth of the hopping channel is at most 1 MHz.

• All spurious emissions outside 22 MHz of the center carrier must be lower than 50 dB relative to the center frequency.
• Systems operating in the 2400-2483.5 MHz band that are used exclusively for fixed, point-to-point operations may employ transmitting antennas with directional gain greater than 6 dBi provided the maximum peak output power of the intentional radiator is reduced by 1 dB for every 3 dB that the directional gain of the antenna exceeds 6 dBi.  Example:

§ 151. Purposes of chapter; Federal Communications Commission created

"For the purpose of regulating interstate and foreign commerce in communication by wire and radio so as to make available, so far as possible, to all the people of the United States a rapid, efficient, Nation-wide, and world-wide wire and radio communication service with adequate facilities at reasonable charges, for the purpose of the national defense, for the purpose of promoting safety of life and property through the use of wire and radio communications, and for the purpose of securing a more effective execution of this policy by centralizing authority heretofore granted by law to several agencies and by granting additional authority with respect to interstate and foreign commerce in wire and radio communication, there is created a commission to be known as the "Federal Communications Commission", which shall be constituted as hereinafter provided, and which shall execute and enforce the provisions of this chapter."

Excerpt from the Bill of Rights, Amendment I:

"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press..."

Please observe that this does not contain any exceptions along the lines of "except when certain influential industry groups want to preserve their ability to plunder a public resource such as the RF spectrum for their own profit."

"Everyone has the right to freedom of opinion and expression; this right includes freedom to hold opinions without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers."

Please observe that this does not contain any exceptions along the lines of "except when the amount of spectrum allocated to public communication has been arbitrarily limited in order to keep individuals and small groups from using it."
