Mayes County Amateur Radio Club
Constitution & By-laws
Amended January 31, 2020
We, the undersigned, wishing to secure for ourselves the pleasures and benefits of an association of
persons commonly interested in amateur radio, constitute ourselves the Mayes County Amateur Radio
Club and enact this constitution as our governing law. It shall be our purpose to further the exchange of
information and cooperation between members, to promote radio knowledge, fraternalism and
individual operating efficiency, and to so conduct club programs and activities as to advance the
general interest and welfare of amateur radio in the community, provide support for the operation of the
MCARC repeaters, and have fun while doing so.

Article I: Membership
All persons interested in amateur radio communications shall be eligible for membership.
Membership shall be open to anyone, licensed or not, upon such terms as the club shall provide in its
By-Laws. A member may lose his/ her membership by acting with conduct unbecoming to a ham, by
continuing to use poor radio operating procedures that would reflect poorly on the club, or willfully
jamming the repeaters. Officer positions are to be held by licensed operators only; however, any
member may hold an appointed position.
Applications for membership shall apply to all licensed members of a family. Membership
applications may be submitted at regular meetings, or at special club functions to the club treasurer or
another club officer on behalf of the club treasurer. Applications for membership must be accompanied
by appropriate dues, and are not acceptable unless paid in full. When the application is received, and
the treasurer has received the money due, the member will at that time be added to the club roster.
Voting members are those who are licensed amateurs. Proxy votes will only be allowed after 60 days
of joining the Mayes County Amateur Radio Club, and for legitimate medical reasons only.
Voting members are those who are licensed amateurs with club dues paid current.
Unlicensed persons who have an interest in ham radio or in the process of obtaining their license will
be allowed to vote after 60 days of joining the Mayes County Amateur Radio Club.

Article II: Membership Assistance
MCARC officers, when notified of a disability of any person that is interested in ham radio and has
studied, using online, various study materials or class attendance, may notify, in writing, the
appropriate VE session of this individual to be given the appropriate testing methods.
These can be verbal or any other method allowed by FCC and guidance by the ARRL VE manual,
presently on pages 50-51.

The Club, through Designated Interference, Public Relations, and Operating Committees will provide
technical advice to members concerning equipment design and operation to assist in frequency
observance, clean signals, uniform practice, and absence of spurious radiations from club member
stations. The club shall also maintain a program to foster and guide public relations.

Article III: Dues
The club, by a majority vote of those voting members present at any regular meeting, may levy upon
the general membership such dues or assessments as shall be deemed necessary for the business of the
organization. Non-payment of such dues or assessments shall be cause for expulsion from the club
within the discretion of the voting membership. A regular yearly assessment of $20.00 per member, or
family, due at the January club meeting, is hereby assessed in accordance with the provisions of this
article of the constitution for the purpose of providing funds for expenses, and maintenance of club
equipment. Dues are non-refundable. Any donations are always appreciated.

Article IV: Meetings
The by-laws shall provide for regular and special meetings. At regular meetings a minimum of one-
third of the voting members shall constitute a quorum for the transaction of business. Regular meetings
shall be held each calendar month. The president upon the written request of any member may call
special meetings. Members shall be notified at least 48 hours prior to special meetings and the business
to be transacted. Only such business as designated shall be transacted. Nominations for club officers
shall be made in writing before the close of the December meeting of the year proceeding elections.
Ballots will be prepared and ready for distribution to voting members at the January meeting.
The Officers have the authority to declare “Emergency Actions” when it is necessary to immediately
take steps to waive or correct anything in these By-Laws. This action can be taken at a regular meeting
by 60% of the voting quorum, or at a special meeting called by the President, or Vice-President, if the
President is not available. If it is deemed to be only a single event, no further action is necessary. If
the event is thought to be one that may occur later, then adding it to the By-Laws will be considered
appropriate.

Article V: Officers
Sec. 1. The officers of this club shall be voting members and consist of President, Vice-President
Secretary and Treasurer.
Sec. 2. The officers of this club shall be elected for a term of two (2) years by ballot by a show of
hands of the voting members present at the annual January meeting.
Sec. 3. Vacancies occurring in between elections must be filled by special elections at the first
meeting following the withdrawal or resignation.
Sec. 4. Officers may be removed by three-fourths vote of the voting members
Sec. 5 The club officers shall appoint such positions that may include any positions deemed
necessary. Appointed positions shall end at the same time as the other officer positions, and shall
require re-appointment upon election of new officers.

Article VI: Duties of Officers
Sec. 1. The President shall preside at all meetings and conduct them according to the rules adopted.
He/She shall enforce due observance of this constitution and/or by-laws; decide all questions of order;
sign all official documents adopted by the club, and perform all other duties pertaining to the office of
President. The President shall also appoint one club adviser at his/her own discretion.
Sec. 2. The Vice-President shall assume all the duties of the President in his/her absence. In
addition, he/she shall advance club interests and activity as approved by the club.
Sec. 3. The Secretary shall keep a record of the proceedings of all meetings, keep a member roster,
keep completed membership applications, carry on all correspondence, and read communications at
each meeting. It shall also be the duty of the Secretary to keep the Constitution and By-Laws of the
club and have the same with him/her at every meeting. He/she shall note all amendments, changes and
additions of the Constitution and/or By-Laws and shall permit it to be consulted by members upon
request. He/she shall also maintain a written copy of all club equipment, its serial numbers and its
current location. An accounting of club owned equipment will be made by the Secretary at the second
meeting of the year. At the expiration of his/her term he/she shall turn over all items belonging to the
club to his/her successor within 30 days.
Sec. 4 The Treasurer shall receive and receipt for all monies paid to the club; keep an accurate
account of all monies received and expended; pay no bills without authorization (by the club or its
officers constituting a business committee.) At each meeting he/she shall submit an itemized statement
of disbursement and receipts. He/she will also be responsible to see that signature cards for the
checking account are updated annually; at the discretion of the President and to make sure that they are
changed to reflect the changes in officers when an officer resigns. At the end of his/her term he/she
shall turn over everything in his/her possession belonging to the club to his/her successor within 30
days.

Article VII: Liability Waivers
Everyone volunteering to provide communications at special events must sign a waiver releasing the
Mayes County Amateur Radio Club and its officers from liability for any accident resulting in injury,
death, or accidents resulting in damage to personal property or equipment. Anyone not signing the
waiver must not be allowed to participate in any form in any function.

Article VIII:
Emergency Communications. Any licensed amateur operator is granted permission to use the
MCARC repeaters in any and all emergency situations.

Article IX: Club equipment
All club owned equipment will be kept in one location as much as possible, as designated by the
President. Anyone having permission to use equipment for a club approved activity will have access to
said equipment. All equipment must be returned within 7 days after each event. Club equipment shall
not be used by anyone or any other organization without being brought before the club and approved
by the voting members in advance. An accounting of club owned equipment will be made at the
second meeting of the year.

Article X: Amendments
This Constitution and/or By-Laws may be amended by a two-thirds vote of voting members present.
Proposals for amendments shall be submitted in writing at a regular meeting, provided all voting
members have been notified of the intent to amend the Constitution and/or By-laws at said meeting.
